Is auto dialing legal in India? What TRAI rules say in 2026

Is auto dialing legal in India? Using an auto dialer app is not banned, but TRAI's telemarketing rules decide which calls you may make with it, from which numbers, and to whom.

Is auto dialer illegal?

The short answer to “is auto dialing legal in India” is that the software is legal but the calls are regulated. TRAI's rules say promotional calls must come from registered senders on 140-series numbers, ordinary 10-digit mobile numbers may not be used for telemarketing, and senders must tell their operator in advance that they use an auto dialer.

General information, not legal advice. Rules were checked against official TRAI, DoT and MeitY documents on 5 October 2026. For your own situation, ask a lawyer or your telecom operator.

An auto dialer is software that calls a stored list of numbers one after another, and in India the software itself is not banned. What is regulated is the call. TRAI’s Telecom Commercial Communications Customer Preference Regulations (TCCCPR), first issued in 2018 and amended on 12 February 2025 and again on 18 September 2026, treat any call whose main purpose is to sell or promote as a commercial communication. Since the 2025 amendment, commercial calls may only come from senders registered with a telecom operator, promotional calls must use 140-series numbers, and service or transactional calls by banks, insurers and similar regulated firms use the 1600 series. TRAI states that ordinary 10-digit mobile numbers may not be used for telemarketing. Every sender must also tell its operator in advance, in writing, that it uses an auto dialer. The 2026 amendment adds a seven-day limit on calls based on a customer’s enquiry. Weo Dialer, which dials from the SIM in each phone, is covered by the same rules.

Auto dialing to enquiries and existing customers

The common case for small businesses is calling people who filled a form, sent a WhatsApp message or rang the office first. Three points from the official texts matter here.

Service calls are treated differently. A call to an existing customer about their order, delivery, warranty or service, with no promotion in it, is a service call and is excluded from the definition of unsolicited communication. TRAI is explicit that mixing any promotional content into such a call turns the whole call promotional.

Enquiries open a short window. Under the 2026 amendment, a commercial call based on an enquiry is allowed for seven days from the enquiry, and only if the enquiry was made in writing or through digital means and is kept in verifiable form. TRAI’s explanatory memorandum notes that senders often treat an oral enquiry as permission; the amendment does not accept that. Keep the form entry, WhatsApp message or email.

The strict wording has no lead exception. The 2025 rules say a sender not registered for commercial communications shall not make any commercial communication. They do not exempt calls to people who asked to be contacted. In practice, TRAI’s process starts from complaints and from call-pattern analysis, but the text itself is strict, and businesses that make sales calls at volume should talk to their operator about registration.

Cold calling rules in India

Calling people who never asked, for example from a bought or scraped list, is where the rules are tightest:

  1. Promotional calls need a registered 140-series number, and calls are checked against the recipient’s DND preferences. Ordinary SIMs cannot be used for this.
  2. Recipients do not need to be on DND to complain about an unregistered sender, and have seven days to do so.
  3. Operators look for patterns: calls to an unusually wide range of numbers, short average call durations and few incoming calls. Using four or more mobile numbers on one handset within a month is also a flagged signal. What happens to a SIM blocked for calling too much is set out step by step in a separate guide.
  4. Number-harvesting software is barred from operators’ networks under the 2018 regulations.
  5. From about May 2027, the DPDP Act will require a lawful basis for holding a person’s data. A bought list gives the caller neither the person’s consent nor the “voluntarily provided” basis that an enquiry does.

Auto dialing complaints and penalties

Under the 2025 amendment, a complaint needs the caller’s number, the complainant’s number, the date and a short description of the call. Against an unregistered sender, the operator checks its call records within one business day, and if five or more different people have complained in the last ten days, it suspends outgoing services on all of that sender’s numbers, whether or not those numbers made the calls. TRAI’s 2025 press release says action against unregistered senders now takes 5 days instead of 30.

If the violation is proven, the first instance bars outgoing services on all the sender’s numbers with every operator for 15 days. Second and later instances mean disconnection of all the sender’s numbers for one year, blacklisting so that no operator issues new numbers, and blocking of the devices used. The 2026 amendment adds AI-based flagging by operators and, once its later provisions start, action on three complaints within ten days when the number has also been flagged.

Auto dialer checklist for Indian businesses

A practical reading of the rules, not legal advice:

  1. Call people who asked, and keep the proof: the form entry, WhatsApp message or email, with its date.
  2. Call enquiries quickly. Under the 2026 amendment the enquiry window is seven days, which is why a sales follow up schedule should put most calls in the first week.
  3. Keep service calls free of promotion. Order, delivery and service calls to existing customers are treated differently only while they stay non-promotional.
  4. Talk to your operator about registering as a sender if you make promotional calls, and notify it in writing that you use an auto dialer app.
  5. Do not spread calls across many SIMs in one handset; four or more numbers on one device in a month is a named warning sign, and one person may hold at most nine connections across India (six in Jammu and Kashmir, Assam and the North East).
  6. Stop calling anyone who asks you to stop, and make sure that number leaves every list.
  7. Get ready for the DPDP Act: a notice explaining what you store and why, reasonable security, and deleting data once it is no longer needed. The same Act matters when you track your own staff’s calls; see call tracking app for employees and the guide on how to track employee calls fairly.

In Weo Dialer, the source tag on each lead records where an enquiry came from, remarks keep what the customer said, and the excluded numbers list keeps a number out of every automatic call, message and backup. Those help with points 1 and 6; they do not replace registration with your operator. How teams organise this day to day is covered on the CRM for telecallers page, and source tags on the lead management app page.

Auto dialing in India: open points

Some questions are not settled by the official documents read on 5 October 2026:

  • Exact start dates of the 2026 amendment. Its parts start 30, 60 and 90 days after Gazette publication; the publication date was not confirmed, so the dates above are estimates.
  • Tap-to-call dialers. The 2026 amendment covers calls “initiated by an application … without direct human dialling”, and TRAI declined to exclude calls with a live agent. Whether a dialer that waits for a person to tap call on each number counts is not addressed. The dialer types are explained in what is a power dialer.
  • Daily call thresholds. TRAI prescribes thresholds for pattern detection but has not published the numbers.
  • Business call recording. No official rule on recording your own customer calls was found; the practical side is on the call recording CRM page.

Auto dialing rules in India FAQ

Is auto dialing legal in India for calling my own enquiries?

Calling people who asked you to call is the lowest-risk use, but the rules do not carve it out completely. Under TRAI's 2026 amendment, commercial calls based on an enquiry are allowed for seven days from that enquiry, and the enquiry must be in writing or digital and kept in a verifiable form.

Does Weo Dialer make auto dialing legal in India?

No app can do that. Weo Dialer places calls from the SIM in your phone, so TRAI's rules apply to those calls exactly as they would if you dialled each number by hand. What the app can do is keep a record of where each lead came from and keep numbers that asked you to stop out of every call list.

What happens if people complain about my calls?

Under the 2025 rules, if five or more different people complain about an unregistered sender within ten days, the operator suspends outgoing services on all of that sender's numbers. A proven first violation bars outgoing calls on all the sender's numbers for 15 days; repeat violations mean one year of disconnection, blacklisting and blocking of the devices used.

Do I need to tell my telecom operator that I use an auto dialer?

Yes. Since the 2025 amendment, every sender must notify its operator in writing, in advance, about the use of an auto dialer and the purpose of the calls. The 2026 amendment replaces this with a declaration of app-initiated calls and the number ranges used for them.

How many calls per day can I make from one SIM?

No official per-day limit for ordinary subscribers was found in TRAI or DoT documents. Operators instead flag patterns such as calls to many different numbers, short average call durations and few incoming calls, using thresholds that TRAI prescribes but has not published.
